MALAYSIA, 10/09/2024 (Asia News Channels) - The wholesaler and retailer, Mydin Mohamed Holdings Bhd, was fined RM20,000 by the Magistrate's Court for selling cosmetics without notification from the Ministry of Health (KKM). The offence occurred last year.
Magistrate Farah Nabihah Muhammad Din issued the penalty after the company, represented by Raja Azlan Raja Ismail, 40, and Roslizan Mohd Zin, 50, pleaded guilty to two charges.
The court ordered each individual, as the defendants, to pay a fine of RM10,000 or face one year in jail if they failed to make the payment. Both fines were paid.
According to the charges, the defendants sold 209 boxes and 23 sets of unnotified toothpaste products at Mydin's supermarkets in Taman Danau Kota and Kompleks Sinar Kota on the morning of July 18, 2023.
The charges were made under Regulation 18A(1)(a) of the Control of Drugs and Cosmetics Regulations 1984, punishable under Section 12(2) of the Sale of Drugs Act 1952. For a first-time offence, the maximum fine is RM50,000, while subsequent offences can incur fines up to RM100,000.
The prosecution was led by Siti Nur Sarahidah Jayatan, a prosecutor from the Pharmacy Services Division of the Kuala Lumpur and Putrajaya Health Department. The two defendants were not represented by legal counsel.
